Madam President:
By means of the present, in accordance with the provisions of the regulations in force, I come to communicate
the following essential information of Transbank S.A (‘Transbank’ or the “Company”).
On August 8, 2022, the Third Chamber of the Supreme Court, in the orders on Appeal of
Claim of the Tribunal de Defensa de la Libre Competencia, titled “Multicaja con Tribunal de
Defense of Free Competition”, Ingreso de Corte ROL N*82.422-2021, issued a final judgment that
is available on the portal of the Judiciary (https: //oficinajudicialvirtual.pjud.cl/), hosting
the resources of claim deducted by Organization of Consumers and Users (ODECU), Walmart
Chile S.A., Farmacia Ahumada S.A. and Copec S.A., against the judgment of September 21, 2021
issued by the Tribunal de Defensa de la Libre Competencia. Instead, it is resolved that the
Query raised by our company in relation to the tariff system it has adopted, in quality
of self-regulation, with merchants and issuers, on the one hand, and with PSPs and operators who wish
interconnect with us, in the context of the procurement services you are providing
in the 4-part model.
The Company is evaluating the scope and implications of the failure, which will be reported to the
Commission for the Financial Market (CMF) as soon as they are defined.
