As established in the applicable legislation and in the General Standard No. 30 and its amendments, in my
As General Manager and duly empowered to do so, I hereby report the following “ESSENTIAL FACT”
relating to Sociedad Concesionaria Autopista del Itata S.A. (the “Company”):
By instrument dated June 14, 2022, the General Directorate of Public Works Concessions of the Ministry
of Public Works (MOP) and the Company signed the so-called “Ad-Referendum Agreement N*3 of the
Concession of the Fiscal Public Works called “North Access to Concepción” (the “Ad-Referendum Agreement N”* 3”), in
By virtue of which, taking into account the provisions of Article 19? of the applicable Public Works Concessions Law
and Article 71? of its Regulations, it was established that as of July 1, 2022 and throughout the term of the
concession “North Access to Concepción”, the Company will not apply the readjustment of the maximum rates (tolls) according to
to the variation of the CPI referred to in article 1.6.57.4 of the Bidding Rules of the Concession Contract. Likewise,
said Ad-Referendum Agreement No 3 regulated the compensation mechanism for the Company for the effect of such
non-application of the rate adjustment formula to be recorded in an “Income Account”.
The Ad-Referendum Agreement N?3, will have full validity and validity from the publication in the Official Gazette of the Decree
Supreme to approve it.
