From our consideration:
As established in the applicable legislation and in General Standard No. 30 and its amendments, in
in my capacity as General Manager and duly empowered to do so, I hereby report the following “FACT
ESSENTIAL” relating to Sociedad Concesionaria Autopista del Aconcagua S.A. (the “Company”):
On May 23, 2022, the Company requested, in accordance with the provisions of article 36 “of the Law of
Applicable Public Works Concessions, the intervention of the H. Conciliation Commission for the Contract of
Concession “Route 5, Santiago -Los Vilos Section” (the “Concession Contract”), in order to propose to the Company and
to the Ministry of Public Works (MOP) conciliation bases to resolve discrepancies between them
last, relating to the Road Safety Award (PSV) and the Guaranteed Minimum Income (IMG) established in the
Concession Contract, as well as the effects on the PSV derived from the Ad-Referendum Agreement N? 8 (pass)
by Supreme Decree MOP No. 96 of 2020), and with instructions given by the Tax Inspector of the Contract
of Concession in its office ORD. N* 955 of April 2022 linked to such discrepancies.
By means of a resolution issued by the H. Conciliation Commission on May 23, 2022, it was considered
presented the petition of the Society, it was conferred transfer to the MOP, and all the effects of the
cited official letter ORD. N* 955 until the discrepancies between the parties are resolved.
