From our consideration:
As established in the applicable legislation and in the General Standard No. 30 and its
modifications, in my capacity as General Manager and duly empowered to do so, hereby
I report the following “ESSENTIAL FACT” regarding the Sociedad Concesionaria Autopista del Aconcagua
S.A. (the “Company”):
On May 11, 2022, the General Directorate of Public Works of the Ministry of Works
Public (MOP), concluded with the Company the so-called “Agreement Ad-Referendum N*9 of the Contract
of Concession of the Fiscal Public Works called “Concession route 5, section Santiago-Los Vilos'” (in
hereafter also Ad-Referendum Convention N*9), under which, according to articles 19* of the Law
of Public Works Concessions and 69″ of its Regulations, modifications were established to the
characteristics of the works and services of the concession contract, valuing and recognizing the
higher costs and expenses associated with the modification provided by Resolution DGC (Exempt)
N*011 of February 8, 2022 processed on March 8, 2022.-
In this context, the Company shall:
a) Develop the final engineering project called “PID Implementation System
Stop charge €. Go Trunk Las Vegas”;
b) Execute, supply, implement and enable the works, equipment and derived systems
the final engineering project referred to in point (a) above;
c) Preserve, maintain, operate and exploit the works, equipment and systems derived from the
engineering project referred to in point (a).
For the development of the corresponding engineering project, the Ad-Referédum Agreement
N*9 considers an investment of UF 10,950, and for execution, supply, implementation and qualification of
works UF 57,633; Without prejudice to other concepts referred to in the same Convention, such
such as administration and control, insurance during construction, warranties, maintenance and
conservation.
The Ad-Referendum Agreement N*9, will enter into force a published in the Official Journal the Decree
Supreme to approve it.
