Madam President:
In accordance with the provisions of Articles 9 and 10 of Law No. 18,045 and General Rule No. 30 of the CMF, I inform you, as an essential fact, that yesterday we have learned that the Second Civil Chamber of the Superior Court of Justice of Lima decided to deliver to Hipermercado Tottus S.A. the bond letters granted by Mall Aventura S.A., Peruvian subsidiary of the Company, at the time of filing a claim for annulment of the award of Arbitration Case No. 622-2019-CCL, which was rejected. In this case, the application of a fine to Mall Aventura S.A. for the non-participation of Hipermercado Tottus S.A. in the Shopping Center owned by Mall Aventura S.A. in the Peruvian town of San Juan de Lurigancho was discussed. In response to this resolution, Mall Aventura S.A. will proceed to pay Hipermercado Tottus S.A. an amount equivalent to UF 283,979 in compliance with the provisions of the aforementioned award.
