Dear Sir or Madam:
In accordance with the provisions of Article 9 and the second paragraph of Article 10 of Law No. 18,045, and the provisions of General Standard No. 30, duly authorized by the Board of Directors in a meeting held on this same date, I inform the Financial Market Commission, as an ESSENTIAL FACT of LATAM Airlines Group S.A. (“LATAM” or the “Company”), The following:
– As informed, LATAM was part of a reorganization process in the United States of America according to the rules established in Chapter 11 of Title 11 of the Code of the United States of America, filing a voluntary application for protection thereunder (the “Chapter 11 Procedure”). As reported by essential fact dated November 3, 2022, with that date LATAM successfully emerged from said Chapter 11 Proceeding.
– As part of the reporting obligations that LATAM has to comply with within the Chapter 11 Procedure, there is the preparation and delivery of a monthly report called MOR for its acronym in English Monthly Operating Report (“MOR”). As of this date, the delivery of the MOR corresponding to the month of October 2022, the last month prior to the departure of Chapter 11 Procedure, is pending.
– By virtue of the above, we make available to your Commission and the market in general, the last MOR corresponding to the month of October 2022, which was issued today included in the following link https://www.latamreorganizacion.com/publicaciones/.
– The REM does not in any way replace the financial information that the Company regularly submits in accordance with applicable securities standards and/or regulation and has been prepared for the sole purpose of complying with the obligations under Chapter 11 Procedure.
Consequently and without prejudice to the other limitations detailed in the MOR, we remind you that the information contained in this report made exclusively to comply with the obligations under the Chapter 11 Procedure, is not audited, has a limited scope and covers a restricted period of time so it is subject to material changes as the corresponding quarter progresses and in accordance with the regular processes of preparation of statements. quarterly financials, including limited review by external auditors where appropriate.
Finally, we note that although LATAM emerged from Chapter 11 Proceedings on November 3, certain provisions of Chapter 11 of Title 11 of the United States Code still impose certain obligations on the Company. One of these obligations is to issue as part of the closure of Chapter 11 Proceedings, on a quarterly basis, reports called “Post Confirmation Reports”. These reports shall be issued together with the quarterly financial statements.
