HECHO ESENCIAL
FONDO DE INVERSIÓN SARTOR LEASING
Ref: Comunica embargo de Fondo de Inversión Sartor Leasing De mi consideración:
Debidamente facultado y de conformidad con lo dispuesto en el artículo 18 de la Ley N*20.712 y en los artículos 9 y 10 de la Ley N*18.045, se comunica el siguiente Hecho Esencial respecto al Fondo de Inversión Sartor Leasing (el Fondo), administrado por Sartor Administradora General de Fondos S.A. en liquidación (la Administradora):
Como se informara oportunamente, con fecha 28 de febrero de 2025 se ha recibido notificación de demanda del 12%uzgado Civil de Santiago, la cual indica lo siguiente: Un Ministro de Fe requerirá de pago a don FONDO DE INVERSIÓN SARTOR LEASING para que en el acto del requerimiento pague a ASB Bank Corp o a quien sus derechos represente la suma de
$8.999.128.055. más intereses y costas. No verificado el pago en el acto de la intimación se trabará embargo en bienes propios del deudor equivalentes a la suma adeudada intereses y costas, los que quedarán en poder del ejecutado en su calidad de depositario provisional y bajo su responsabilidad legal, debiendo procederse en todo arreglo a la Ley.
Por su parte, con fecha 6 de marzo de 2023 un receptor judicial trabó embargo sobre los bienes del Fondo de Inversión Sartor Leasing que se individualizan en el anexo adjunto, que corresponde al 100% de la cartera de propiedad de dicho Fondo.
Señalamos que, para evitar esta medida judicial, esta Administración mantuvo y mantiene comunicaciones y negociaciones con ASB Bank Corp; sin embargo, no ha sido posible ofrecer una alternativa razonable para el acreedor debido a los insuficientes flujos de caja generados en el corto plazo, y adicionalmente, esta Administradora no ha accedido al otorgamiento de garantías sobre la cartera existente.
